Sutton Law Firm Attorneys Awarded FEC Advisory Opinion on 6-0 Vote (April 2016) 361


On April 14, 2016, the Federal Election Commission unanimously approved Advisory Opinion 2016-01 (Ethiq, Inc.).  The Advisory Opinion extends the Federal Election Campaign Acts’ media exemption for the first time to a smartphone “app,” and permits Ethiq to distribute content to users based on a unique algorithm that assesses user preferences relative to political and other interests.

 

Sutton Law Firm attorneys Brad Hertz and Nick Sanders requested the opinion, appeared before the Commission to answer questions about their client’s app and the applicable law and regulations.
